These Terms of Service (“Terms”) govern your access to and use of the Nobettr mobile application, website, and related services, including any features, content, community tools, progress tracking, reminders, challenges, and subscription services (collectively, the “App” or “Service”) provided by Herrs J Holdens LLC (“Nobettr,” “Company,” “we,” “us,” or “our”).
By downloading, installing, accessing, subscribing to, or using the App, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must immediately stop using the App and delete it from your device.
IMPORTANT DISCLAIMERS
Self-Help, Educational, and Wellness Disclaimer
Nobettr is a self-help, habit-tracking, and wellness application designed to support users who want to quit, reduce, or better manage sports betting and gambling-related habits.
The App:
- is not a medical service
- is not therapy or counseling
- is not financial advice
- is not gambling treatment
- is not a crisis service
- is not a medical device
- does not diagnose, treat, cure, or prevent any condition
- does not guarantee that you will stop gambling, stop betting, avoid relapse, or improve your financial situation
Nothing contained in the App constitutes medical advice, mental health advice, addiction treatment, financial advice, legal advice, or professional counseling. No doctor–patient, therapist–client, financial advisor–client, or healthcare provider relationship is created by your use of the App.
If you are experiencing severe gambling problems, addiction concerns, financial distress, mental health distress, thoughts of self-harm, or a crisis situation, you should seek help immediately from a qualified professional, crisis support service, emergency service, or gambling support organization.
The App is not a substitute for professional treatment, therapy, addiction counseling, financial counseling, or emergency assistance.

Nobettr addresses topics related to sports betting, gambling habits, compulsive behavior, financial loss, urges, triggers, relapse, and habit change. These topics may involve sensitive personal, emotional, psychological, and financial issues.

Individual Results Vary
Behavioral change, habit modification, gambling recovery, and addiction recovery are highly individualized processes. Nobettr does not guarantee any particular result, including abstinence, relapse prevention, reduced urges, financial recovery, emotional improvement, improved relationships, or psychological benefit.
Risk of Emotional Distress
Tracking betting behavior, logging relapses, recording losses, viewing streak data, reviewing progress, or participating in community discussions may cause emotional reactions, including stress, anxiety, frustration, embarrassment, guilt, shame, disappointment, or sadness. Such reactions are a possible part of using habit-tracking and recovery-support tools.
Not a Clinical Program
Nobettr does not provide addiction treatment, behavioral therapy, psychological counseling, medical care, crisis intervention, or financial counseling. The App is not intended to replace professional care for gambling addiction, compulsive gambling, mental health conditions, or financial distress.
User Responsibility for Decisions
You remain solely responsible for your personal decisions, actions, gambling-related choices, financial decisions, and behavioral choices. Any decisions regarding gambling behavior, abstinence strategies, mental health treatment, financial management, or lifestyle changes should be made independently or in consultation with qualified professionals.
No Monitoring of User Behavior
Nobettr does not monitor, verify, or control your behavior outside the App. We cannot confirm whether you have placed bets, avoided betting, relapsed, met your goals, or followed any plan or recommendation.
Community Content Is Not Professional Advice
Content shared by other users in forums, comments, community spaces, or other interactive features does not constitute professional advice and may not be accurate, safe, appropriate, or suitable for your situation.
No Betting, Gambling, or Sportsbook Services
Nobettr is not a sportsbook, casino, gambling platform, betting exchange, odds provider, gambling operator, or financial betting tool. The App does not allow users to place bets, wager money, participate in gambling, receive betting picks, or access gambling services.
Release of Behavioral and Financial Harm Claims
To the maximum extent permitted by law, you agree that Nobettr and Herrs J Holdens LLC shall not be liable for any claims arising from: relapse or inability to stop gambling; continued sports betting; emotional distress related to habit tracking; financial losses or gambling-related losses; mental health outcomes associated with use of the App; interactions with other users; reliance on App insights, streak metrics, reminders, challenges, or progress tracking tools; or any decisions you make based on your use of the App.
1. Eligibility
You must be at least 16 years old or the age of digital consent in your jurisdiction to use the App. If you are under the age of 18, you represent that:
(i) a parent or legal guardian has reviewed these Terms; and
(ii) your use of the App is supervised where required by law.
Nobettr reserves the right to suspend or terminate accounts where age requirements are not met.
The App is not intended to promote, encourage, or enable gambling by minors or by any person legally prohibited from gambling.
2. Account Registration and Security
To access certain features, you may be required to create an account using Apple, Google, email, or another supported login method.
You agree to:
- provide accurate and current information
- maintain the security of your account credentials
- promptly notify us of any unauthorized access
- accept responsibility for all activity occurring under your account
Nobettr is not responsible for losses caused by unauthorized account access, failure to secure your device, or failure to protect your login credentials.
3. License to Use the App
Subject to your compliance with these Terms, Nobettr grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, access, and use the App solely for your personal, non-commercial use.
No other rights are granted. All rights not expressly granted are reserved by Nobettr and Herrs J Holdens LLC.
4. Intellectual Property Ownership
The App and all related technology, including but not limited to software, algorithms, databases, designs, graphics, text, branding, trademarks, logos, user interface elements, analytics systems, habit-tracking models, streak systems, progress tracking tools, challenges, community features, and related content, are and shall remain the exclusive property of Nobettr, Herrs J Holdens LLC, or its licensors.
These materials are protected by applicable intellectual property laws, including copyright laws, trademark laws, trade secret laws, patent laws, and international intellectual property treaties.
5. Intellectual Property Restrictions
You may not, directly or indirectly:
- copy, reproduce, modify, distribute, sell, license, or create derivative works of the App
- reverse engineer, decompile, disassemble, or attempt to extract source code
- attempt to obtain proprietary algorithms, models, databases, or internal systems
- scrape, harvest, download, or collect data from the App
- use bots, crawlers, spiders, scripts, or automated access tools
- mirror, frame, or replicate the App on another service
- use the App to build, train, or support a competing product or service
- use the App or its content to train artificial intelligence or machine learning systems
- attempt to access non-public APIs, infrastructure, or backend systems
- probe, scan, test, bypass, or interfere with App security protections
- bypass rate limits, authentication systems, payment systems, or subscription controls
6. AI Training and Data Extraction Prohibition
You may not use the App, its content, data, functionality, user-generated content, or underlying technology to train, develop, fine-tune, validate, benchmark, or improve any artificial intelligence, machine learning, large language model, or automated decision-making system without the prior express written consent of Nobettr.
Without limiting the foregoing, users may not scrape, extract, collect, download, or otherwise obtain data, content, or information from the App for the purpose of training, validating, benchmarking, or developing any machine learning or artificial intelligence models.
7. Protection of Platform Integrity and Enforcement
Nobettr takes the protection of its platform, systems, data, users, and intellectual property seriously. Any unauthorized access to, use of, or interference with the App, its infrastructure, its data, or its underlying technology is strictly prohibited.
Without limiting any other rights or remedies available under these Terms or applicable law, Nobettr reserves the right to investigate, monitor, and take appropriate action against any individual or entity that engages in conduct that compromises, attempts to compromise, or interferes with the security, integrity, or lawful operation of the App or its systems.
8. User Content
The App may allow you to create, upload, submit, save, or share content such as progress logs, urge logs, relapse logs, streak information, notes, comments, goals, check-ins, journal entries, and community posts.
You retain ownership of your content. However, by submitting content through the App, you grant Nobettr and Herrs J Holdens LLC a worldwide, non-exclusive, royalty-free license to store, process, analyze, display, transmit, and use such content solely for the purpose of operating, maintaining, securing, personalizing, and improving the App and its related services.
9. Prohibited Conduct
You agree not to violate any applicable laws, promote gambling or casinos, post betting picks or odds, encourage other users to relapse, harass other users, upload harmful content, impersonate others, spam, or interfere with the App's normal operation.
10. Community Content Disclaimer
Content submitted by users reflects solely the opinions, experiences, and statements of those users. Nobettr does not endorse, verify, or assume responsibility for any user-generated content.
11. Subscriptions and Billing
Certain features of the App may require a paid subscription. Subscriptions may be purchased through the Apple App Store, Google Play, or another authorized payment processor. All billing, cancellations, and refunds are governed by the applicable platform provider's terms and policies.
12. Free Trials and Promotions
Nobettr may offer free trials, promotional pricing, or discounts. Unless canceled before the end of the trial period, your subscription may automatically renew and you may be charged according to the selected plan.
13. Beta Features
From time to time, Nobettr may release experimental or beta features. Such features are provided on an “as is” and “as available” basis without warranties of any kind.
14. AI and Automated Features
The App may include automated, algorithmic, or AI-assisted features. These features are provided for general informational, motivational, and self-help purposes only, and are not professional medical, financial, or legal advice.
15. Third-Party Services
The App may integrate with or provide access to third-party services. Nobettr is not responsible for any third-party content, policies, services, availability, or data practices.
16. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL RELATED CONTENT, FEATURES, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOBETTR AND HERRS J HOLDENS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING EMOTIONAL DISTRESS, FINANCIAL LOSSES, OR RELAPSE OUTCOMES.
18. Indemnification
You agree to indemnify and hold harmless Nobettr, Herrs J Holdens LLC, and their affiliates from any claims arising out of your use of the App or your violation of these Terms.
19. Arbitration and Class Action Waiver
Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively through binding arbitration in the State of Delaware under the American Arbitration Association rules.
20. Termination
Nobettr may suspend, restrict, or terminate your access to the App at any time, with or without notice, if you violate these Terms or create security or reputational risk.
21. Changes to the App
Nobettr reserves the right to modify features, discontinue services, change pricing, or limit access to certain features at any time without notice.
22. Changes to These Terms
We may update these Terms from time to time. Your continued use of the App after updated Terms become effective means you accept the revised Terms.
23. Corporate Transactions
In the event of a merger, acquisition, or sale of assets, user account information may be transferred to the successor entity.
24. Export Compliance
You may not access or use the App in violation of United States export control laws or sanctions regulations.
25. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.
26. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nobettr regarding your access to and use of the App.
